On February 16, Congressman Tim Murphy (R-PA) reintroduced H.R. 1122, the Secondary Payer Advancement, Rationalization, and Clarification Act, or SPARC Act. Originally filed last September, the bipartisan bill never moved out of committee. The SPARC Act seeks to ensure that Medicare Part D (which is available for prescription drug coverage) is adequately reimbursed when another entity is determined to be the primary payer. Most often, this occurs with workers’ compensation claims, motor vehicle accidents, or liability claims.
CMS recently revisited the task of reviewing its process for addressing requests for CMS to “re-review” otherwise approved Workers’ Compensation Medicare Set-Aside Arrangement (WCMSA) amounts. In Calendar year 2017, CMS expects to update its existing re-review process to address situations where CMS has provided an approved amount, but settlement has not occurred and the medical care that supported the approved amount has changed substantially.
